Your use of the TrafficCleaner.com web site (the "Web Site") means you agree to the following Terms of Use. If you do not agree with these terms please leave this Web Site immediately and do not use the material and services therein.

1. TERMS OF USE

The following types of sites are NOT allowed to participate in TrafficCleaner.com: sites encouraging illegal activity or racism, sites providing instructions or discussions about performing illegal activities, sites that promote or utilize software or services designed to deliver unsolicited email, or any other sites we deem to be inappropriate.
You agree not to change the TrafficCleaner.com filter code that you will insert on your site.
If this agreement is terminated by us or by you for any reason, you agree to remove our code, logos and trademarks from all of your Web sites and other items.
We both own the data regarding visitors to your Web site that we collect. You can use the data we provide for any legal purposes. We will use the data in compliance with our privacy policy.
Users acknowledge and agree that their Web site information (site name, URL, traffic counts, etc.) may be utilized by TrafficCleaner.com. Possible uses include (but are not limited to) a directory of the sites using our service, general promotional uses, etc.

Memberships:

Basic: basic members can use certain services for free of charge without time limitation. Basic members have the opportunity to upgrade their membership to Premium level any time.
Premium: premium members can use all services for a recurring monthly fee. The current monthly fees rates are listed in the Upgrade menu of the members’ area.
Trial: each new member is given a 28 days trial period. During this period trial members can use all services for free of charge. Once the trial period has ended the membership will automatically be converted to the free Basic membership. Trial members as well as Basic members have the opportunity to upgrade their membership to Premium level at any time.

Cancellations:

Basic and Trial members can cancel their free membership by sending us a request through our support form.
Premium members can cancel the recurring of their membership any time by clicking on the “Cancel my membership” button in the Status menu. The successful cancellation will be confirmed on the website as well through an e-mail confirmation.
The membership level will be downgraded to the free Basic level once the expiry date defined by the payment period is reached.

Fees and Payments:

Premium members of the service are required to purchase the "Membership" in order to use the "paid features" of the Service.
In order to purchase a "Membership", the user may charge it to a credit card online. In addition to paying the published price, the purchaser is responsible for paying all applicable taxes in connection with the purchase. We reserve the right to change our pricing policy at any time at our sole discretion. We also reserve the right to change the method or manner in which we charge members for the "Membership", or the method of payment which is acceptable to us, at our sole discretion.
Once we have confirmed receipt of your payment, we will upgrade your account to the "Membership" level you have subscribed for. Where we receive payment for an incorrect amount or non-US$ we will upgrade or credit your account based on the funds received, converted to US$ at the market exchange rate at the time of processing minus any exchange charges incurred by us. You can check the status of your "Membership" at any time by clicking the "Status" and "History" menus in the "Your account" section of the website, when you are logged-in as a member. A paying member whose account has expired will be downgraded to "Basic Member" level (free), and may not access "paid features" until renewing his Membership. If your usage of the Service is terminated because of a breach of this agreement or if it is terminated for any reason, your "Membership" is automatically and immediately forfeited.
Recurring membership: when you subscribe to our service as a paying member, the length of the membership is set by default to "30 days recurring". This means that once you have become a subscribing (paying) member, your subscription will be automatically renewed and your credit card will be charged, every 30 days. Credit card charges will be processed within 24 hours after a paid membership period is selected.
You may cancel the automatic recurring billing of your membership any time by clicking on the "Status" menu in "Your account" section and selecting the "Cancel your membership" button. You will not be given a refund for unused time. All features available to you according to your already paid membership level will continue to be available to you until the end of the payment period in which you requested to opt-out of your paid membership. Once the payment period has expired, your account will be converted to the Basic Membership, through which you will continue to have access to all features supported by the Basic Membership level.
THE PURCHASE OF PAYING MEMBERSHIP IS NON-REFUNDABLE. Any unused paid "Membership" will remain on your account and will not be refunded if unused, even if you are no longer using the service. The paid "Membership" may not be transferred from one member of the service to another member. The cost of the paid "Membership" is not refundable under any circumstance.
You agree to pay or have paid all fees and charges incurred in connection with your paid membership with the service (including any applicable taxes) at the rates in effect when the charges were incurred. All fees and charges are non-refundable. We may change the fees and charges in effect for using the service, or add new fees or charges, by posting new fees and changes on the site from time to time. You also are responsible for any fees or charges incurred to access the service through an internet access provider or other third party service, including but not limited to telephone charges. YOU, AND NOT WE, ARE RESPONSIBLE FOR PAYING ANY AMOUNTS BILLED TO YOUR CREDIT CARD BY A THIRD PARTY, WHICH WERE NOT AUTHORIZED BY YOU.

Monthly traffic limit of the Premium membership:

If the Premium member excessively and regularly overuses the monthly traffic limit (hits) assigned to his membership level, TrafficCleaner.com reserves the right to modify the amount of the recurring payment according to the next appropriate billing level. Changes will be effective with the next payment period. TrafficCleaner.com will send an email notification about the changes to the Premium member two weeks ahead of the next billing period.

2. INTELLECTUAL PROPERTY RIGHTS

We retain ownership and all rights to TrafficCleaner.com logos, trademarks, software, trade secrets, databases, reports, and Web site.

3. WARRANTIES AND LIMITATION OF LIABILITY; TERMINATION

You agree to use our services at your own risk. Our services are provided on an "as is" and "as available" basis. You agree that you have made your own determination regarding the usefulness of the service. We disclaim all warranties including, but not limited to, warranties of merchantability and fitness for a particular purpose.
We are not liable for damages, direct or consequential, resulting from your use of the service, any failure to provide service, suspension of service, or termination of service. We do not guarantee the availability of the service. You agree not to hold us responsible for data loss or interruption of service of any kind.
YOU AGREE TO DEFEND, INDEMNIFY AND HOLD US HARMLESS FROM AND AGAINST ANY AND ALL CLAIMS, LOSSES, LIABILITY COSTS AND EXPENSES (INCLUDING BUT NOT LIMITED TO ATTORNEY'S FEES) ARISING FROM YOUR VIOLATION OF THIS AGREEMENT OR ANY THIRD-PARTY'S RIGHTS, INCLUDING BUT NOT LIMITED TO INFRINGEMENT OF ANY COPYRIGHT, VIOLATION OF ANY PROPRIETARY RIGHT AND INVASION OF ANY PRIVACY RIGHTS. THIS OBLIGATION SHALL SURVIVE ANY TERMINATION OF THIS AGREEMENT. OUR LIABILITY WILL NOT EXCEED THE PURCHASE PRICE OF THE SERVICES.
We or you may terminate your account and remove your site from our database at any time for any reason.

4. PRIVACY AND INFORMATION

We believe the privacy of all our users is important. Please review our privacy policy relating to the collection and use of your personal information.

5. GENERAL

Blue Star Ltd. reserves the right to change or amend these Terms of Use at any time without prior notice. Any rights not expressly granted herein are reserved. These Terms of Use shall be governed by the laws of Switzerland without giving effect to any principles or conflicts of law. If any provision of this agreement shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions. To report TrafficCleaner.com related spam to us, please send a message to support@trafficcleaner.com. Be sure to include a copy of the offending email.

Spam definition

In simple terms Spam (a.k.a. unsolicited commercial e-mail, unsolicited bulk e-mail, mass e-mail, junk e-mail, etc.) is a message that advertises goods or services that you send to someone without their prior consent or in the absence of a previous relationship.

Spam is defined as including, but not limited to, the following:

Email messages that are addressed to a recipient with whom the sender does not have an existing business or personal relationship with or is not sent at the request of, or with the express consent of, the recipient.
Messages posted on Usenet and message boards, which are unrelated to the topic of discussion, unrelated newsgroups or sent/posted excessively.
Solicitations posted on chat rooms or to groups or individuals by Instant Messaging system, such as ICQ.

Policy

TrafficCleaner.com strictly prohibits the sending of unsolicited mass e-mails of any kind. We will not tolerate Spam and will terminate any member who violates our anti-Spam policy. Your account will be closed, your data will be lost and you will not be allowed to rejoin.
